Notice of Intent to Request Release of Funds

On or about October 11, 2019 the Town of Cumberland will submit a request to the Rhode Island Office of Housing and Community Development for the release of Public Facility and Improvements funds under Title 1 of the Housing and Community Development Act of 1974 (P.L. 93-383) to undertake a project known as Cumberland Senior Center Rehabilitation for the purpose of rehabilitating the interior and exterior of the building, as well as improving the surrounding landscape. The estimated project cost is $703,500 with $500,000 provided in HUD funding. The Cumberland Senior Center is located at 1464 Diamond Hill Road, Cumberland, RI.  

The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA). An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the Town of Cumberland Department of Planning and Community Development, 45 Broad Street, Cumberland, RI 02864. The ERR is available for review and may be examined and copied weekdays between 8:30 A.M. and 4:30 P.M.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the Town of Cumberland Department of Planning and Community Development.  All comments received by October 10, 2019 will be considered by the Town of Cumberland prior to authorizing submission of a request for release of funds.

ENVIRONMENTAL CERTIFICATION

The Town of Cumberland certifies to the Rhode Island Office of Housing and Community Development that Jeffrey J. Mutter in his capacity as Mayor of the Town of Cumberland consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  The Rhode Island Office of Housing and Community Development’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Town of Cumberland to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

The Rhode Island Office of Housing and Community Development will accept objections to its release of fund and the Town of Cumberland’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Town of Cumberland; (b) the Town of Cumberland has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the Rhode Island Office of Housing and Community Development; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the Rhode Island Office of Housing and Community Development at One Capitol Hill, 3rd Floor, Providence, RI 02908.  Potential objectors should contact the Rhode Island Office of Housing and Community Development to verify the actual last day of the objection period.
